Scrap Tire Management Program

The Scrap Tire Management Unit provides central coordination for the Ohio EPA District Office and Health Department administration of the Scrap Tire Program.  Questions or issues with specific scrap tire facilities should be addressed to the approved local health department and/or appropriate Ohio EPA District Office.  Questions concerning scrap tire transporters or Out-of-State scrap tire facilities should be directed to the Scrap Tire Management Unit.

Questions or issues concerning financial assurance should be addressed to Ohio EPA's Compliance Monitoring and Enforcement Unit.

The Scrap Tire Management Unit is the primary point of contact for:

  • Processing scrap tire transporter registrations (OAC 3745-27-54)
  • Providing verification of currently registered scrap tire transporters
  • Providing information on Out-of-State scrap tire facilities
  • Development and interpretation of scrap tire rules
  • Providing training and guidance on scrap tire rules
  • Compiling scrap tire annual report information on scrap tire transportation, collection, storage, processing, and disposal in Ohio
  • Overseeing the state financed cleanup of tire piles in Ohio that pose the most significant threats to human health, public safety, and the environment

Ohio EPA District Offices are the primary contact for:

  • Processing scrap tire facility registrations (OAC 3745-27-61) and permits
    (OAC 3745-27-63)
  • Providing technical assistance to facilities, health departments, and citizens in their district in areas without a Approved Local Health Departments
  • Inspection of Scrap Tire Transporters operating in their district
  • Inspection of Scrap Tire Facilities located in their district in areas without an Approved Local Health Department.
  • Review of scrap tire beneficial use requests

A scrap tire as defined in Ohio Administrative Code (OAC) 3745-27-01, is a solid waste and includes all unwanted or discarded tires including: used tires until they have been installed on a vehicle, scrap tire pieces that are still recognizable and contain wire or fiber. Scrap tire transportation, collection, storage, processing, disposal, and beneficial use is regulated in Ohio per Ohio Revised Code (ORC) sections 3734.70, 3734.71, 3734.72, 3734.73, 3734.74, and 3734.84. Registration or permitting and licensing are required before accepting any scrap tires.

Anyone transporting scrap tires into or out of Ohio must first register with Ohio EPA Scrap Tire Management Unit unless they qualify for one of the exemptions in OAC 3745-27-54. An annual registration fee and financial assurance with the State of Ohio is required.  Registration as a scrap tire transporter in another state is not sufficient.

Anyone collecting, storing, processing, or disposing of scrap tires in Ohio must first obtain a registration or permit from Ohio EPA, unless they qualify for an exemption listed in OAC 3745-27-61 or OAC 3745-27-63.  They must also obtain a solid waste

facility license from the Approved Local Health Department (OAC 3745-37-15). If the local health department is not approved, the license can be obtained from the appropriate Ohio
EPA District Office. The application for a facility registration or permit should be submitted to the appropriate Ohio EPA District Office. Annual licensing fees, financial assurance, and one time registration or permitting fees are based on the size of the facility.

Disposal of scrap tires in Ohio can only occur at permitted and licensed scrap tire monofills (OAC 3745-27-70) or scrap tire monocells (OAC 3745-27-69). The permit application must be submitted to the appropriate Ohio EPA District Office.  The license application must be submitted to the Approved Local Health Department.  Fees for the permit and license are based on the permitted authorized maximum daily waste receipts.  Financial assurance is based on estimated closure costs for the facility.

The beneficial use of whole, cut, or shredded scrap tires must be in accordance with OAC 3745-27-78. Prior approval of a project plan by Ohio EPA is required unless the beneficial use is for 100 tires (or less) or is approved by rule in OAC 3745-27-78.

The clean up of open dumps of scrap tires is an important part of Ohio's scrap tire program. Enforcement actions are initiated to get the responsible parties and the property owner to clean up the scrap tires. When the responsible parties or property owners fail to clean up the scrap tires, Ohio EPA can hire a contractor and seek cost recovery from the responsible party or place a lien on the
property. A summary of scrap tire cleanups in Ohio and a Scrap Tire Cleanup Plan is submitted to the Ohio Controlling Board each year. This plan includes a summary of how the scrap tire fee has been spent.

A Scrap Tire Market Development Grant program is administered by the Ohio Department of Natural Resources - Division of Recycling and Litter Prevention. Additional information on the grant program is available on the website.
