Pursuant to ORC Section 3714.062, Ohio EPA has created an operator certification program for construction and demolition debris landfill operators.  Effective July 1, 2019, Construction and Demolition Debris Landfills are required to have a certified operator on site, or reasonably available every day during disposal operations. However, since the program is in its initial certification cycle, Ohio EPA will use discretion to extend the initial certification deadline to coincide with the timing of the 2020 annual license application and renewal cycle later this year. To become a certified operator, a person needs at least twelve months of work experience at landfill operations and ten hours of approved education training pursuant to OAC Rule 3745-400-26-(B)(2). Once the operator meets those criteria, they can apply to become a certified operator. The certified operator must renew the certification before December 31 of each year.

C&DD Certified Operators and Approved Health Departments

Ohio EPA's Division of Materials and Waste Management (DMWM) recognizes the challenges the COVID-19 pandemic has placed on Ohio's Construction and Demolition Debris (C&DD) Facilities and their Certified Operators. DMWM continues to work closely with training providers to ensure Certified Operators have access to as many training options as possible. 

DMWM encourages all C&DD Certified Operators to make every effort to complete the required annual 10 education hours by December 31, 2020. However, DMWM acknowledges that some Certified Operators may need additional time to fulfill their training requirement this year. 

On November 22, 2020, Governor DeWine signed HB 404 that extends several broad provisions relating to the issuance and expiration of licenses, permits, and certifications. Ohio EPA determined this applies to C&DD Certified Operators. Consequently, Ohio EPA will extend the deadline for obtaining 2020 annual education hours to July 1, 2021 to align with HB 404. 

Please note this extended deadline only applies to the education hours needed during the 2020 calendar year. All certified operators will need to complete 10 education hours separately during calendar year 2021. When submitting certified operator applications for renewal, please note if the documented training hours apply for the 2020 or 2021 calendar year requirement.

On June 30, 2017, the 132nd Ohio General Assembly passed Senate Bill 2. This bill states that the director of environmental protection shall adopt new rules governing construction and demolition debris processing facilities.  The rules will address issuance of permits-to-install and annual licenses as well as conditions for the location, design, construction, operation and closure of C&DD processing facilities.  When Senate Bill 2 becomes effective on Oct. 6, 2017, uncodified Section 4. of the bill requires C&DD processing facilities to submit an Application for Registration notifying the licensing authority (Board of Health or Ohio EPA). The Application for Registration will be available by Oct. 6, 2017.

• Evaluation of Ground Water Quality at C&DD Landfills FACT SHEET
  Ohio Revised Code Section 3714.071 allows a board of health or the director of environmental protection to conduct ground water monitoring at licensed C&DD facilities to detect negative impacts on ground water. This FACT SHEET describes the process Ohio EPA has implemented to conduct this program, including evaluating each C&DD landfill using “priority criteria,” developing a preliminary Hydrogeologic Investigation Report (pHGI) for each landfill, and meeting with the owner/operator to discuss the outcome of the investigation and next steps.


• Reimbursement for C&DD Ground Water Activities FACT SHEET
  Ohio EPA is in the process of completing a pHGI Report for all licensed C&DD facilities. If the pHGI concludes that additional ground water monitoring is warranted, then Ohio EPA or the owner/operator must perform the ground water activities in accordance with Ohio Revised Code Section 3714.071. This FACT SHEET describes the process of how, in certain situations, an owner/operator can be reimbursed for installation of new ground water monitoring wells and sampling and analysis of the ground water.
